Please read these Terms of Service carefully before using CircuitX. By downloading, installing, or using the app, you agree to be bound by these terms. If you do not agree, do not use CircuitX.
These Terms of Service ("Terms") govern your use of the CircuitX mobile application ("App") developed by CircuitX ("we", "us", or "our"). By using the App you confirm that you are at least 13 years old and that you accept these Terms.
CircuitX is a fitness tracking and coaching application available on iOS and watchOS. The App provides workout tracking, AI-generated fitness coaching, gamification features (XP, levels, streaks, badges), social features, and optional premium subscription features ("CxMaxx").
CircuitX does not require a traditional username/password account. Your data is tied to your Apple ID and iCloud account. You are responsible for:
CircuitX offers an optional auto-renewable subscription called CxMaxx, which unlocks premium features including advanced AI coaching, smart trainer, deep analytics, structured plans, and streak shields.
Subscription Terms
• Monthly plan: $9.99 USD per month
• Yearly plan: $59.99 USD per year (billed annually)
• A 7-day free trial is offered to new subscribers. You will not be charged during the trial period.
• Payment is charged to your Apple ID account at confirmation of purchase or at the end of the free trial.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
• To cancel, go to iPhone Settings → Apple ID → Subscriptions → CircuitX.
• No refunds are provided for partial subscription periods.
Subscription management is handled entirely by Apple. CircuitX does not have access to your payment information.
Physical exercise involves inherent risk of injury, including but not limited to muscle strains, joint injuries, cardiovascular events, and in rare cases, serious injury or death. By using CircuitX you voluntarily assume all risks associated with physical activity undertaken while using the App.
You represent that you are physically capable of engaging in exercise and that you have consulted, or will consult, a licensed physician or qualified healthcare professional before beginning any fitness programme — particularly if you have or suspect any of the following: heart disease or cardiovascular conditions, high blood pressure, diabetes, respiratory conditions, joint or bone injuries, chronic illness, pregnancy, or any other medical condition that may be affected by physical exertion.
CircuitX, its developers, officers, employees, and affiliates shall not be liable for any injury, illness, death, or other harm arising from your use of the App or from your engagement in any physical activity suggested, recommended, or facilitated by the App.
You acknowledge that you have read this warning, understand its content, and accept full personal responsibility for your safety during all physical activities undertaken through or inspired by CircuitX.
The AI Coach and Smart Trainer features provide AI-generated fitness recommendations for informational and motivational purposes only. These features:
Always use your own judgment and consult a qualified professional before following any AI-generated advice. Stop any exercise immediately if you feel pain, dizziness, shortness of breath, or discomfort. Use of AI features is entirely at your own risk.
By using the AI Coach or Smart Trainer you confirm that you understand these limitations and waive any claim against CircuitX arising from your reliance on AI-generated recommendations.
CircuitX requires users to be at least 13 years of age. Users between the ages of 13 and 17 should obtain parental or guardian consent before using the App and before undertaking any fitness programme. By using CircuitX you represent that you meet the minimum age requirement or have obtained appropriate parental consent.
CircuitX may request access to Apple Health data including step count, heart rate, active energy, and workout sessions. Granting this access is optional. Health data is used only to enhance your in-app experience and is processed in accordance with our Privacy Policy. We do not sell or share your health data with third parties for advertising.
You agree not to:
All content in CircuitX — including but not limited to the app design, graphics, icons, text, AI-generated content, workout structures, and code — is owned by or licensed to CircuitX. You may not copy, modify, distribute, or create derivative works from any part of the App without written permission.
Your personal workout data (routines you create, sessions you log) belongs to you.
We reserve the right to suspend or terminate your access to CircuitX at any time if you violate these Terms or engage in conduct we deem harmful to other users or the App. You may stop using the App at any time and delete your data via Settings → Account → Delete Account.
CircuitX is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.
To the maximum extent permitted by applicable law, CircuitX, its developer, owners, officers, employees, affiliates, and licensors shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, including but not limited to:
In no event shall CircuitX's total cumulative liability exceed the amount you paid for CxMAXX in the twelve (12) months preceding the claim, or fifty US dollars ($50.00), whichever is greater.
Physical activity involves risk of injury. Always exercise within your limits and consult a doctor before starting a new fitness programme.
You agree to indemnify, defend, and hold harmless CircuitX, its developer, affiliates, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the App; (b) your breach of these Terms; (c) any injury or harm you sustain during physical exercise undertaken while using or relying on the App; or (d) your violation of any applicable law or regulation.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
You and CircuitX agree that any dispute, claim, or controversy arising out of or relating to these Terms or the use of the App — including but not limited to claims of personal injury, property damage, or any other claim arising from physical exercise, AI recommendations, or any feature of the App — shall be resolved exclusively through final and binding individual arbitration rather than in court, except for claims that qualify for small claims court.
Class Action Waiver: You and CircuitX agree that each party may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class, consolidated, or representative action. You expressly waive any right to participate in a class action lawsuit or class-wide arbitration.
Arbitration Rules: Arbitration shall be conducted by a neutral arbitrator in accordance with the rules of the American Arbitration Association (AAA) Consumer Arbitration Rules. The arbitration shall be conducted in English, and judgment on the arbitration award may be entered in any court of competent jurisdiction.
Opt-Out: You may opt out of this arbitration agreement by sending written notice to CircuitX within 30 days of first accepting these Terms. If you opt out, you and CircuitX agree to submit to the exclusive jurisdiction of the state and federal courts located in the State of South Dakota for the resolution of any disputes.
Severability: If any portion of this arbitration provision is found to be unenforceable, the remainder shall continue in full force and effect.
These Terms are governed by and construed in accordance with the laws of the State of South Dakota, United States, without regard to conflict of law principles.
We may update these Terms from time to time. We will notify you of material changes via an in-app notification or an updated "Last updated" date. Continued use of the App after changes take effect constitutes your acceptance of the revised Terms.
CircuitX is distributed through the Apple App Store. Apple is not a party to these Terms and has no obligation to provide any maintenance or support for the App. In the event of any conflict between these Terms and Apple's App Store terms, Apple's terms shall govern with respect to your use of the App Store.
